If in the course of normal business (including complaints from the general public) we discover you are violating our Terms of Service Agreement we may terminate your account and optionally refund the balance of your account. You agree to maintain accurate information by providing necessary updates during entire time of using our services. Therefore, you agree to be responsible for protecting any information or data you place on our servers. You agree to be responsible for backing up your data. Specific nature of VPS service implies that Customers have to set up everything themselves and are therefore responsible for data backups. You agree you will not use our service for file sharing and file distribution of copyrighted material from your Virtual Private Server. This could result in account termination without refund. Excessive bandwidth usage for the purpose of file sharing or file distribution via automated programs such as BitTorrent, BearShare, is not allowed and can result in account termination. You agree not to compromise or cause harm in any way to Tomcat Hosting equipment or other user accounts. This could result in immediate termination of an account. You agree not to use our services to host any website, links or advertisements of websites that violate any copyright, trademark, patent or other proprietary rights of any third party information. You agree not to use our services to host any website connected with child pornography or declared hatred for particular social, ethnical, religious or other group.
Tomcat Hosting agrees to provide any and all services requested by the Customer during signup and specified with selected package. We will not be expected to provide any other services unless agreed to in writing between the Customer and one of our service representatives. We guarantee 99.9% network uptime and server stability. This excludes hardware breakdowns of the server, user errors or intentional interruptions of the user service, failure due to software usage that is not explicitly supported by Tomcat Hosting. In no event shall Tomcat Hosting or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Tomcat Hosting services, even if Tomcat Hosting or a Tomcat Hosting authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Tomcat Hosting may revise these terms of use for its services at any time without notice. By using our services you are agreeing to be bound by then current version of these Terms of Service.
